1. Layout, copy and design on MyHoliday.com.
MyHoliday.com reserves the right of final approval over the elements created for the site. This includes final designs, layouts and elements related to the functionality of the site and associated web pages.
MyHoliday.com reserves the right to edit copy, layouts or photographic elements as needed. This includes copy entered into our online databases by advertisers.
MyHoliday.com is not responsible for any damages or loss due to the layouts of property advertisements, their positioning on the site, or any changes made to photographs, copy and other elements submitted by our customers.
2. Accuracy of advertisements.
MyHoliday.com bears no legal responsibility for the accuracy of advertisements submitted to the site, or for allegations of breach of contract by any advertiser. Further, the advertiser shall indemnify MyHoliday.com against all expenses, costs and losses proceeding from a claim relating to any advertisement content.
It is the responsibility of the advertiser to maintain an accurate and upto-date account of a property’s availability. This especially applies during time periods when Searchable Special Offers are being displayed, because special offers will not display if the time period in question is listed as “booked” on the availability chart. 3. Photographs.
MyHoliday.com will expend every effort to protect all materials supplied to us. We will also attempt to return these elements if desired. MyHoliday.com cannot be held responsible in the event of loss or damage to such materials. While every effort will be made to create and maintain an accurate reproduction of all advertisements submitted, MyHoliday.com cannot be held responsible for any losses or damages, even if resulting from errors and/or omission.
4. Liability.
MyHoliday.com does not warrant that the functioning of the MyHoliday.com site will be error-free or uninterrupted. In no event shall MyHoliday.com be liable to any advertiser for any incidental, direct, special or consequential damages, including but not limited to loss of profits.
5. Copyright.
MyHoliday.com shall be entitled to reproduce in part or as a whole, any photographic materials submitted by an advertiser.
-MyHoliday.com claims copyright to electronic images produced from the photographic materials submitted by an advertiser.
-It shall be the responsibility of the advertiser to procure permission for reproduction of all photographic and non-photographic materials used in their advertisements). By submitting such materials, the advertiser warrants that he/she is the owner of copyright for said materials, or has had authority granted by the actual owner for the purpose of posting the material on MyHoliday.com. MyHoliday.com cannot be held responsible for any infringement of copyright laws due to materials supplied by advertisers. The advertiser indemnifies MyHoliday.com against any proceedings brought for breach of copyright or breach of other rights due to the use of
material supplied by the advertiser.
6. Hypertext links.
MyHoliday.com reserves the right to refuse hypertext links to other web sites. We reserve the right to remove such links or copy bearing web addresses of other sites, at our discretion, and without notice to the advertiser.
7. Substitution of properties.
An advertisement shall be defined as relating to a specific property, and that property may not be substituted or replaced by another property.
8. Multiple properties in one advertisement.
Each advertisement on MyHoliday.com shall be defined as being composed of only one property, offered for holiday use by our renting customers.
Only one property may appear per advertisement, with the exception
of a property offering multiple rental units at the same site, and in this case only if additional advertising units are purchased. MyHoliday.com reserves all rights to modify the copy, or remove the advertisement, in cases where more than one property is listed.
9. Termination of advertisements.
Upon advertiser request, MyHoliday.com will remove advertisements from the site before the end of the subscription period, but will make no refunds in such instances. MyHoliday.com reserves the right to refuse or remove any advertisement from the MyHoliday.com web site. MyHoliday.com will not be liable for any losses incurred by an advertiser as a result of this policy.
-Persistent misuse of the MyHoliday.com online tools or entry of prohibited or unlawful material on the site will result in the removal of the property from the site, with no refunds.
-MyHoliday.com takes customer satisfaction seriously. Complaints from renters of properties listed on MyHoliday.com will be investigated. If in the reasonable judgement of MyHoliday.com, a complaint is deemed justi-fied, we reserve the right to delete the property listing from the MyHoliday.com web site without notice. Other actions by an advertiser which will cause removal include: knowingly double-booking a property; engaging in any other breach of obligations to MyHoliday.com; engaging in unacceptable practices as defined by MyHoliday.com.
10. Payment.
Advertising on MyHoliday.com must be paid for with euros, pounds orAmerican dollars, using major credit or debit cards.
11. Legal jurisdiction.
The terms and conditions set out above are to be governed by Spanish law, and advertisers agree to accept the sole jurisdiction of the Spanish courts to rule on any disputes. The court specified is in Malaga, Spain.
